Beginning of BUMD PDPA

Starting from the Regional Regulation of the Special Region of Aceh Province Number 4 of 1994 concerning the Establishment of the Aceh Development Regional Company, a ‘Business’ unit of the Government of Aceh was formed called the Aceh Development Regional Company (PDPA) with a legal entity as a Regional-Owned Enterprise.

In the regulation, especially Article 5 Paragraph (1), it is stated that the Regional Company was established with the aim and objective of increasing local revenue, participating in the development of the regional economy, expanding equitable development and its results.

The regulation was later strengthened by Aceh Qanun No. 16/2013, concerning the equity participation of the Government of Aceh in Aceh-Owned Enterprises. This Qanun states that Aceh Government Capital Participation is the transfer of ownership of Aceh’s assets which were originally assets that were not separated into separated assets to be calculated as Aceh’s capital in Regional-Owned Enterprises with the principle of mutual benefit.

PDPA Metamorphoses into PT PEMA

The revocation of the legal entity form regulated by Permendagri No. 3 of 1998 concerning BUMD, through Permendagri No. 11 of 2016 and referring to Law No. 23 of 2014 that BUMD formed before the Law, must change its form within a maximum of 3 (three) years after the Law was passed.

The legal regulations regarding the change of form of Perumda to Perseroda are regulated in the third part of article 114 of PP No. 54/2017 on BUMD and the implementing regulations are regulated in Permendagri No. 118/2018 on Business Plans, Work Plans and Budgets, Cooperation, Reporting and Evaluation of Regional-Owned Enterprises.

The Government of Aceh as a full shareholder, issued a change in the form of PDPA to Perseroda referring to Qanun No. 16 of 2017 concerning the change in the legal form of PDPA to PT PEMA.

After the enactment of the Aceh Qanun, the implementation of the change is carried out with the mechanism of establishing a PT as stipulated in the PT Law.

The change in the form of PDPA to Perseroda was then legalized as evidenced by a Notary Deed and ratification from the Minister of Law and Human Rights, PDPA changed its form to PT PEMA on April 8, 2019 with 100% share ownership owned by the Aceh Provincial Government.

Business Division of PT PEMA

Since officially becoming a Regional-Owned Enterprise (BUMD), PT PEMA focuses on the main businesses in oil and gas, mining business, electricity, industry, trade, construction, agribusiness, fisheries, property, transportation and tourism.

As a business unit of the Government of Aceh, PT PEMA is required to be able to contribute to the receipt of Regional Original Revenue (PAD) which will have an impact on the development of Aceh’s economy so as to improve the welfare of the community and organize public benefits.

This is in accordance with Law No. 5/1962 on Regional Companies, Law No. 32/2004 on Local Government and Permendagri No. 52/2012 on Guidelines for Local Government Investment Management.

To achieve these objectives, the Company established two main divisions, namely:

Oil, Gas, Mining, Industry and Trade Division

In carrying out these business activities, each division is important to explain the business planning that will be carried out and outlined in the form of Business Planning for 2022-2026.

Through the organized business scheme, PT PEMA carries out planned development so that the profit target for each current year can be achieved. This will have an impact on increasing Aceh’s economic growth, which leads to increased prosperity for the people of Aceh.
